ACCEPTANCE OF TERMS AND CONDITIONS
These Terms and Conditions govern your access and use of this site and our services. By accessing or using this site or our services you agree to be bound by these Terms and Conditions and to any additional guidelines, restrictions, or rules that may be posted in connection with specific sections or services of this site and all Stanton Publication Services, Inc., d/b/a Bookmobile affiliated websites. All such additional posted guidelines, restrictions, or rules are hereby incorporated by reference into these Terms of Use.
Bookmobile reserves the right to make changes to this site and to these Terms and Conditions at any time without prior notice. You should review these Terms and Conditions each time you access this site.
You also agree that to the extent otherwise required by law, we may provide all legal communications and notices to you electronically by posting them on our website or, at our election, by sending an e-mail to the e-mail address you provided. You may withdraw your consent to receive communications from us electronically by contacting customer service. However, if you withdraw your consent to receive our communications electronically, you must discontinue your use of your account for all Bookmobile services.
GENERAL SERVICES
Pricing Terms: Pricing is good for 30 days from date of quote and reflects material costs at the time of quoting; material costs are subject to change due to pricing increases during production. Quote pricing does not include sales tax if applicable.
Payment Terms: Refer to payment terms listed on the quote and invoice.
E-mail Communication: Bookmobile is not responsible for e-mails that are rejected, redirected, marked as undeliverable or not received due to a customer’s e-mail provider’s spam or filter settings. Bookmobile will not refund, credit, or be held liable for loss of profits, loss of use, or loss of revenue due to a customer’s e-mail provider’s spam or filter settings. It is the customer’s sole responsibility to contact customer service for updated order/job information. By creating an account or ordering from Bookmobile you are agreeing to receive emails from customer service, Bookmobile Newsletters, and any special offers from Bookmobile. At your discretion, you may choose to opt out or no longer receive emails regarding Bookmobile Newsletters or special offers from Bookmobile.
Copyright and Content. The client takes sole responsibility for understanding the copyright laws the work is bound to. The client agrees to hold Bookmobile harmless for all liability, damages, and attorney fees that may be incurred in any legal action connected with copyright infringement involving the work produced or provided. The client also guarantees that the work does not contain content that is libelous or that threatens anyone’s right to privacy or other personal or economic rights. If there is legal action against Bookmobile due to the product’s content, the client will defend Bookmobile in all legal actions as well as cover any legal expenses.
File Management and Archiving: Bookmobile archives all electronic material for a period of 5 years at no charge. However, Bookmobile cannot guarantee that these archived files can be retrieved for future use due to computer system and application updates that are out of Bookmobile’s control. Customers should always keep a copy of their original files. Bookmobile’s archived files may be retrieved at the request of the client, though additional fees may apply.
Termination: Bookmobile reserves the right to reject any order and/or the option to cancel any agreement resulting therefrom, without liability or explanation. If the client cancels a project, they are responsible for any incurred fees including, but not limited to, production time, materials for printing, and management time.
DIGITAL PRINTING
Scheduling: Schedule estimates given are not guaranteed. Schedule delays may occur due to the client not providing print-ready files, meeting deadlines, or unforeseen production issues at Bookmobile.
Original Client Files: Bookmobile requires designed and print-ready PDF files (one file for the cover and one file for the interior) for printing and our file guidelines are at https://www.bookmobile.com/support/ We offer design services separately. Bookmobile does not offer editing or proofreading services.
Corrections: We do need to charge for corrections and the cost is noted on all of our quotes: Corrections: Any changes made after proofs are billed an additional $80.00 per hour. Please keep in mind that even if you’re just adding a comma, we’re running your files through preflight and setting up for press again–in short, the cost will be $40.00 at the minimum.
Spec Changes: Any changes made to specifications (page count, trim size, etc.) will change pricing.
Proof Approval: Should you (the customer) choose to order a Hard Copy proof or request a PDF proof, the customer must approve the proof via https://stacks.bookmobile.com before the order will be printed. Your project will remain on hold until you approve the proof via https://stacks.bookmobile.com giving us the electronic consent to proceed with printing. A confirmation email will be sent to you noting your approval. If no confirmation email has been received within 1 hour, please contact customer service. It will not be moved any further in the printing process and will remain on hold until the consent to proceed with printing has been confirmed. In order to avoid delay please approve your proof as soon as possible. It is the customer’s responsibility to review the proof carefully before sending the order to press and to contact customer service within 1 hour after proof approval. Bookmobile is not responsible for spelling or grammatical errors.
Color Proofing: Because of differences in equipment, paper, toner/inks and other conditions between color proofing and production pressroom operations, a reasonable variation in color between color proofs and the completed job shall constitute acceptable performance.
Quality of Printing and Binding: Bookmobile strives for unsurpassed quality in everything it makes. Inherent in the printing and binding process is the mechanical nature of manufacturing. A mechanical process utilizing paper that contracts and expands with changes in humidity, thickness and temperature guarantees that books will at times have minor flaws such as hickeys, dents, bends, frayed edges, roller marks, scratches, white spots, ink spots, bubbles, broken type, marking, ghosting of images, variation in foil stamping and embossing, color variation, etc. In almost all cases, these minor flaws do not affect the readability (or enjoyment) of the book by the end consumer. Bookmobile will not provide invoice credits and reprints when minor imperfections appear as a result of the high speed mechanical nature of printing and binding. Errors that may result in invoice credits or rework would include missing pages, missing images, or pages in the incorrect order.
Waviness of Text Blocks / Cover Warp / Cover Curl: Paper books are affected by changes in humidity and temperature. Bookmobile’s printing plant is humidity and temperature controlled to minimize waviness and cover warp/curl. When books leave any controlled environment they will react to different humidity and temperature levels (higher or lower). Humidity and or temperature changes will cause paper to absorb moisture or lose moisture and at times result in waviness in the book block and/or endsheets, hardcover warp, or softcover curl. Bookmobile can not control this environmental phenomenon and subsequently can not warrant that its books will not at times exhibit waviness in the book block and/or endsheets, hardcover warp, or softcover curl. Specifically, Bookmobile will not compensate customers or provide a reprint when books or components of the books exhibit waviness.
Over Runs: You can opt to accept overruns–we often end up with extra (and good copies) on a print run. Overruns are billed at a 20% discount on the unit cost, and there would be no more than 12 copies. If you’d like to accept overruns on your titles, please let your CSR know. (If you print galleys with us, we do not offer overruns on galleys.)
Refunds/Returns: Due to the nature of the product, all sales are final and no returns can be made once the order is processed and/or shipped. Any claims for defects, damages, or shortages must be made in writing within two (2) normal operating business days after receipt of the merchandise. We will replace only those orders that we processed incorrectly. The replacement of the order will take place only after 100% receipt of the entire order is returned at the customer’s expense within 5 business days from the actual delivery date. We will not replace the order if it is determined by us that the order was misused/mishandled by the buyer, part of the order was used by the buyer or only a portion of the order is being returned.
Cancellations and Refunds: Once the order has been processed, no refunds or changes shall be made or issued. Any and all cancellations or change orders must be made prior to the order being processed, in writing directly to customer service at csr@bookmobile.com. Any refunds processed shall incur all fees associated with refund. The fees shall be collected directly from the amount to be refunded prior to the refund being issued.
Warranty: Bookmobile disclaims all warranties, whether express, implied, or otherwise, including any warranties of merchantability or fitness for a particular purpose. Bookmobile does not accept any responsibility other than possible replacement of the products that Buyer is buying. Bookmobile may but does not guarantee the replacement of the defective product.
Shipping: Shipping terms are F.O.B. 210 Edge Place, Minneapolis, MN 55418. Bookmobile will arrange for shipping with the carrier on behalf of the buyer. The Buyer will be fully responsible for the shipping and handling cost. Bookmobile will not be responsible for the delay in delivery, loss or damage of the order while the order is with the shipping carrier.
Third Party Shipping: With the use of a third party shipper whether Bookmobile or the customer. We will not be held responsible for delays due to weather, machinery breakdown, errors, late or damaged packages. Delivery dates are estimates from the carriers and can include additional time for transit due to delays. The customer agrees not to hold Bookmobile liable for any loss of profits, loss of use, or loss of revenue due to delays or damaged packages. All damaged packages should be refused immediately and reported to the carrier/delivery driver as damaged. Any damaged package/packages signed for will be deemed fully accepted and no refunds, credits, or reprints will be issued.
Limitation of Liability: Bookmobile will not be liable in contract or in tort (including negligence) to the customer for incidental or consequential damages, arising out of or resulting from anybody’s performance or nonperformance of our obligations. Bookmobile shall not be liable to anyone for any kind of financial losses, cost, expenses, damages and/or other economic damages. The Buyer agrees that the Buyer will not hold Bookmobile responsible for any and all loss, cost, expense, and damages (including legal costs) on account of any and all manner of claims, demands, actions, and proceedings that may be instituted against Bookmobile and its affiliated company (S) on grounds alleging that the said work violates any copyrights, trademarks, service marks, or is scandalous, or invades any person’s right to privacy or other personal rights.
